Trademark and Copyright Filings

Registering Trademarks

There are several steps involved in registering a trademark with the U.S. Patent and Trademark Office. Our skilled attorneys will help you with every step of the process.

First, we conduct due diligence to verify you have a reasonable chance of obtaining your desired trademark. An application for a trademark that is so similar to another existing trademark that it could cause confusion will likely be rejected.

Next, we prepare and file your application with the U.S. Patent and Trademark Office. After you have taken this step, you will need to wait for the trademark office to review the application and provide a report on their findings. Your trademark may be approved at this point, or you may be required to make modifications to it. In some cases, trademark applications are rejected. If that happens, your lawyer will work with you on the appropriate next steps.

We will also help you understand next steps after your trademark is approved, including requirements to maintain your trademark.

Copyright Filings

To be eligible for copyright protection, the work must be fixed in a tangible medium of expression. Under the law, your protection begins as soon as you have completed the work, and you can (and should) display a copyright symbol to assert your intention to protect what you created.

While you have some legal protection whether or not you file with the Copyright Office, doing so can help make enforcing your copyright simpler if you need to take such action.
